Privacy Policy
Irvine Lawyers Pty Ltd respects the privacy of its clients and the readers of this website.
In order that third parties understand and have confidence in how Irvine Lawyers deals with Personal Information, it has developed this Privacy Policy adopting the Australian Privacy Principles (APP).
General
If you are, or become, a client of Irvine Lawyers, you also have the added comfort of Irvine Lawyers’ ethical obligations as your lawyer to protect your Personal Information as part of its lawyer/client privilege duties.
Irvine Lawyers is bound by the Privacy Act 1988 (Cth) including the Australian Privacy Principles (APPs).
The Privacy Act safeguards your right to privacy and the use of your Personal Information, which the Act describes as any form of data that can identify you as an individual.
The APPs regulate the way in which Irvine Lawyers can collect, use, keep, secure and disclose Personal Information. This policy sets out how Irvine Lawyers manages your Personal Information.
Information collected
Personal Information may be collected by Irvine Lawyers when you use the Irvine Lawyers website. That information — including your internet protocol address, operating system, domain name (if applicable), the date and time of your visit, duration of the visit and pages viewed — will be used for statistical purposes to improve Irvine Lawyers’ services.
Irvine Lawyers will also collect Personal Information you provide voluntarily during the course of our business relationship. You may choose to provide personally identifiable information when you contact us with a query, complete a contact form, or request information.
Personal Information we collect may include your name, contact details (postal/residential addresses and phone numbers), email address, date of birth, photographs, facts or opinions connected to an enquiry, and other personal information provided through the Irvine Lawyers website or otherwise requested by us or provided by you.
We may also need to collect Sensitive Information. Sensitive Information is a subset of Personal Information given higher protection under the APPs. It includes, for example, information or opinion about racial or ethnic origin, political opinions, religious beliefs, membership of trade unions, sexual orientation, criminal records, health information and biometric information.
The Personal Information (including Sensitive Information) collected will be referred to in this policy as your “information”.
If we receive your information from third parties, we will protect it as set out in this policy and take reasonable steps to ensure that you are aware we have collected information about you and the circumstances of that collection. If you provide third party Personal Information to us, you warrant that you have the third party’s consent to do so.
Purpose of collection
You consent to Irvine Lawyers collecting Personal Information from you and from third parties to provide legal services, to communicate with you, to provide information relevant to your legal matter or business, to analyse and enhance Irvine Lawyers’ services, and to comply with legal obligations.
The scope and volume of information we may require from you in order to act on your behalf is recognised by the APPs as a “permitted general situation”.
Irvine Lawyers may disclose your information to service providers, agents and contractors when necessary to provide legal services or, on occasion, to market those services to you.
It would be exceptional for your Personal Information to be sent overseas. If this were to occur in a particular case (for example, because of your education/employment or family background), we would explain the circumstances to you and use best endeavours to ensure overseas recipients comply with the Australian Privacy Principles.
Security
Irvine Lawyers is committed to protecting the security of your Personal Information. We use industry standard security technologies and measures to help protect your information from misuse, loss, unauthorised access, modification or disclosure, including electronic and physical security measures.
Please be aware that the internet and email are not inherently secure. If you send Personal Information to Irvine Lawyers via the internet, it is transmitted at your own risk.
Irvine Lawyers stores personal information electronically in its practice management system and/or in hard copy files in accordance with industry practice.
Access
You may request access to Personal Information Irvine Lawyers holds about you by making a written request to the Irvine Lawyers Privacy Officer. We will endeavour to respond and provide access within a reasonable period.
Irvine Lawyers may charge a reasonable fee to cover retrieval and copying costs (this fee will not apply to lodging a request for access). We may decline a request in circumstances prescribed by the Privacy Act, and if so we will advise you of the reasons.
